Lawsuit alleges mayor, council violated state laws with legislation giving administrator power to appoint health department employees.
In a 15-page lawsuit, Hopatcong's board of health alleged the borough mayor and council violated state laws by passing legislation granting their administrator power to appoint health department employees. The board of health said in the lawsuit, filed March 15 with the Sussex County Superior Court, that Mayor Sylvia Petillo and the six-member council wrongfully usurped the board's duties of appointing, supervising and compensating health department workers. Hopatcong Mayor Sylvia Petillo says she sees a new health advisory committee would revitalize public health outreach. But Councilwoman Estelle Klein says the council just wants to run the board of health.
Monday's special council meeting turned into a shouting match as Hopatcong introduced two councilmen to its board of health as well as plans to create a health advisory committee. Estelle Klein's was the only "no" vote when the council passed the first hearing of a law that would establish a five-person committee to be charged, Mayor Sylvia Petillo said, with revitalizing community health outreach. The ordinance still must pass an April 18 vote. Michael Francis and John Young would fill spots vacated by Craig Bradley, who died in November, and Rob Bond, who declined reappointment. Mayor Sylvia Petillo and council members John Young and Estelle Klein were sworn into new terms at Wednesday night's Hopatcong reorganization meeting at the municipal building. Councilman Richard Bunce was named council president and Petillo, in her second straight term, announced the members of the borough's new land-use board, which will replace the zoning and planning boards. Petillo, a Republican who ran unopposed in November alongside GOP mates Young and Klein, sat before a standing-room only crowd and recounted the what she said were her first-term successes, such as amassing $4 million in federal grants, including one for $143,000 that will give four municipal buildings energy-efficient lights and other equipment. Member: 'The town needs a change.'
Three Hopatcong residents hope their last-minute write-in campaign will bring big changes to the borough's political structure. Michele Guttenberger, Randall Paulenich and Mara Modes formed the campaign over the weekend and distributed fliers promoting their candidacies outside Hopatcong's post office Monday afternoon. Guttenberger is vying for the open mayoral spot while Paulenich and Modes are gunning for two open council seats. "The town needs a change," Paulenich said Monday, a day before the state's general elections.
